The State of Disaster is OVER which means no Regulations made under the State of Disaster remain in force
The ANC does not rule by dictatorial decree although they presume to
Context: South Africa
Ramaphosa revoked the State of Disaster at midnight on 5th April 2022. In doing so all the previous regulations made in terms of the State of Disaster fell away. Having revoked the State of Disaster Ramaphosa had no legal authority to make any new Covid regulations, but the wannabe dictator immediately presumed to do so. His decrees from the podium included the wearing of masks indoors, social distancing, limited numbers, etc, etc all of which he said would fall away after thirty days because the National Health Act would be amended on the 15th April and so these temporary regulations would no longer be necessary.
Let us be absolutely clear: Ramaphosa’s supposed temporary regulations LEGALLY never came into effect and they have no force in law; the State of Disaster is over and has been from midnight on 5th April 2022. That means NO MASKS and no other Covid regulation - we are back to pre State of Disaster days. Ramaphosa does not rule by decree, and We the People must not allow him to do so.
Previously on the 15th March 2022, under government notice 1882 the Minister of Health gave notice and published proposed amendments to be made to the National Health Act and giving interested persons thirty (30) days to submit substantiated comments to the Director General Department of Health which period would expire tomorrow, 15th April 2022. The proposed amendments are both naive and draconian and can be found here as required but that’s just a part of it.
Since then, following a flood of substantiated comments, the minister Joe Phaahla has now extended the comments deadline to 24th April 2022. The man is a fool. Phaahla motivates his proposed amendments under Section 90(4)(c) of the National Health Act which reads, and I quote:
"The Minister may, if circumstances necessitate the immediate publication of a regulation, publish that regulation without the consultation contemplated in paragraph (a)."
Paragraph (a) reads; "The Minister must publish all regulations proposed to be made under this Act in the Gazette for comment at least three months before the date contemplated for their commencement." (writer’s emphasis)
By initially stipulating a thirty (30) day comment period Phaahla admits that the “circumstances [do not] necessitate the immediate publication of a regulation” . This means that a minimum three month comment period is required in law.
Phaahla, like Ramaphosa, and other ANC Communist Party deployees presume to rule by decree. To be clear: A minimum three month comment period from the 15th March 2022 is required by law and the law provides no interim periods, it’s immediate, or a minimum of three months and immediate has gone.
Right now, all Covid regulations have expired and no new Covid related amendments have come into effect, or can come into effect before 15th June 2022 and a lot of water is going to flow under the bridge before that date - a lot!
We the People must all assert our Constitutional and other legal rights. We are sovereign people, we are not ANC slaves or subjects to be dictated to by the ANC.
That is how I see it also! 👍
Anthony Fouci was arrested by US Military JAG forces on April 9. He is held at Guantanamo Bay. His Tribunal date is the 18th of April. May this event send shivering scockwaves through the NWO COVIT CRIMINALS
